San Diego Real Estate – Refinancing a Trust Estate

It is not uncommon for an estate to have some property in probate and some property in trust.
I came across this article and wanted to share some of my clients experiences with San Diego real estate in an estate. When appointed as the trustee they became aware that the San Diego real estate had been refinanced, the title had been removed from the trust and may now be subject to probate. The reason is that the decedent may not have been aware that once the refinance was completed, the title needed to be changed from the individual name and put back into the trust name. The good news is the California Heggstad petition! It is a way to get the San Diego real or personal property or California real or personal property into the California trust AFTER death.
