The Challenge
Attorney Marvin Errickson introduced DeLoris to Kim at the beginning of December 2012. She and her husband Dennis live in Minnesota. DeLoris had been appointed as the successor trustee of her father-in-law’s estate. Besides the geographic challenge, there was a reverse mortgage and her husband’s brother, Randy, was still living in the house. DeLoris was concerned because she had received notification from the reverse mortgage lender, Champion Mortgage, with an imposed time limit to sell the house. The lender sent a representative to the property to complete an appraisal.
The Strategy
To protect the asset, DeLoris wanted Randy to continue occupying the estate property. She and Dennis scheduled to come to San Diego. We met, established a market value price of $279,000 and developed a plan of action. One of the steps was the handling of the decedent’s personal property. After interviewing both a buyout company and an estate sales company, she chose to have an estate sale.
The Results
The property was placed on the market on February 6, 2013. Several offers were received and after several days of negotiations, DeLoris entered into a contract. Once the buyer completed their inspections, the buyer requested several items to be repaired. Kim negotiated a cash amount of $1,000 in lieu of repairs. The estate sale was held liquidating the personal property. DeLoris and her family were thrilled with the final sale price of $285,000.
