When using the search words “sell real estate during probate” this article appeared. I do not know the author and when it comes to selling probate real estate in California, the following points are incorrect.
- The California probate real estate appraisal will be completed by a licensed Probate Referee.
- Most California real estate probate sales are under the Independent Administration of Estates Act (IAEA) and do not require petitioning for a court confirmation date and advertising the sale is not necessary.
- There is no mandatory 10% buyer earnest money deposit or court confirmation hearing when the California probate is under the IAEA.
