Introduction

California’s SB 326, also called the Balcony Inspection Bill, is changing the way condo and HOA properties are sold. Signed in 2019, the law initially applied to new builds from January 2020, but older properties now require inspections starting 2025. SB 326 covers elevated exterior structures (EES) such as balconies, decks, and walkways.

The inspection must be done by a structural engineer, who conducts a visual inspection and may use tools like infrared cameras or moisture meters. The report highlights the condition of structures, safety hazards, and recommended repairs. The HOA board then reviews the report and schedules any necessary repairs. Failure to comply with SB 326 can result in penalties.
